A USDOT number, a motor carrier name, a lease decal, a different name on the tractor than on the box, a tank placard, a bin trailer full of tomatoes: each of those changes who is answerable and which rulebook applies. Stanislaus County adds its own variants, because farm equipment, bin haulers and processing-plant traffic share two-lane county roads with commuters. Note the number of axles, whether the load looked shifted, and whether a second company's name appeared anywhere on the equipment.
State Route 132 is the region's main east-west thoroughfare and freight corridor, linking Interstate 5 near Tracy to State Route 99 in Modesto, and it is the only east-west highway crossing the Tuolumne, San Joaquin and Stanislaus rivers. StanCOG's Policy Board named it the region's highest priority corridor, and much of it remains a two-lane conventional highway. The first rebuilt segment, three miles from Dakota Avenue to the Needham Street overpass just west of Highway 99, pulled the route off Maze Boulevard onto a corridor south of Kansas Avenue under a $92 million construction contract, opening with two lanes and a median. The phase now underway builds direct connector ramps between the two highways, replaces the Kansas Avenue bridge over Highway 99, and adds a southbound auxiliary lane, with one stated goal being to move truck and commuter traffic away from the neighborhoods and schools along Maze Boulevard. Until that is finished, heavy vehicles keep mixing with local traffic on a road built for less.
Federal rules set the shelf life. A motor carrier must keep records of duty status and their supporting documents for each driver for not less than six months from receipt, while the driver carries only the previous seven days. Supporting documents are a defined list: bills of lading and itineraries showing origin and destination, dispatch and trip records, expense receipts tied to on-duty not-driving time, fleet management system messages, and payroll or settlement sheets. Drivers submit them within thirteen days, and a carrier need not keep more than eight per driver per day. Nobody may obscure, deface, destroy, mutilate or alter them. The driver qualification file lasts longer, held for as long as the driver is employed plus three years, and contains the employment application, the motor vehicle record from each licensing authority, the road test certificate or its equivalent, the annual review note, and the medical examiner's certificate.
Code of Civil Procedure 335.1 sets two years for an injury action, which feels generous next to a six-month document retention window. If the crash involved a road defect or a public agency's vehicle, Government Code 911.2 cuts the presentation deadline to six months after accrual. A dangerous-condition claim also has elements to prove under Government Code 835. The property must have been in a dangerous condition at the time of injury, the condition must have proximately caused the injury, and it must have created a reasonably foreseeable risk of that kind of injury. Beyond that, either an employee's act created the condition or the entity had notice long enough beforehand to do something.

The preservation demand should identify the tractor, the trailer, the date and the driver, and ask for the electronic logging data, the supporting documents, the qualification file, maintenance and inspection records, dispatch messages and any onboard video. The second mistake is assuming one company owns the whole rig. Tractor, trailer, load and driver can each attach to a different entity, and only paperwork sorts that out.
It moves quickly, because it is staffed to. Investigators and adjusters can be at a Highway 99 or Highway 132 scene the same day, measuring and taking statements while the injured person is still in an emergency department. Insurance behind the truck is usually deeper than a car policy: federal minimums run to $750,000 covering for-hire interstate carriage of ordinary property in vehicles rated over 10,001 pounds, $1,000,000 for oil and many hazardous materials, and $5,000,000 for bulk hazardous substances. Depth cuts both ways, since the defense will spend on reconstruction and on a comparative fault theory placing part of the percentage on you.
Expect the early work to be documentary and mechanical: preservation letters, a request for the CHP report, an inspection of the vehicles before repair or release, and a look at whether an electronic control module still holds usable data. Those steps are costs rather than fees, and the difference matters. California sets no statutory percentage for a traffic claim; Rule of Professional Conduct 1.5(a) forbids an unconscionable or illegal fee, and Business and Professions Code 6147 requires the agreement to be written, signed by both, duplicated to the client, and to state that the rate is negotiable. The numeric ceilings people remember, 25 percent before a filing and 33 percent after, come from Business and Professions Code 6146 and reach claims against health care providers, not a truck case.
