The other driver admits it, or left, or was never identified, and the conversation is instead about what policy exists and whether it responds. Three versions show up in Stanislaus County: the driver who produces nothing, the driver whose carrier denies that the policy was in force, and the driver whose limit is real but small. All three point at the same document, your own declarations page, and at the endorsement most people have never opened.
Insurance Code 11580.2 requires uninsured motorist coverage in a bodily injury liability policy unless the insurer and a named insured agreed in writing to delete it, delete it for a named operator, or reduce it, and even a reduction cannot drop below the state's financial responsibility floor. The offering limits in the statute are $30,000 for one person and $60,000 for two or more. Those track the liability minimums that rose as standard policies renewed through 2025, moving from $15,000 and $30,000 to $30,000 and $60,000, with property damage going from $5,000 to $15,000. The statute also blocks stacking: limits on two or more vehicles or policies cannot be added together to build a bigger pot.
If the driver is unknown, the statute is unforgiving. There must have been physical contact with you or with the vehicle you occupied. The crash must be reported within twenty-four hours to the police department of the city where it happened, or, if it happened in unincorporated territory, to the county sheriff or the local CHP headquarters. Then a statement under oath goes to the insurer within thirty days. Geography matters for that middle step, because Highway 99 runs through Bystrom and Highway 132 through Empire, both unincorporated communities in the county, so a South Modesto crash on a state route may never touch a city agency at all. Hit-and-run is not rare here either: the Office of Traffic Safety counted 389 fatal-and-injury hit-and-run collisions in the county in 2023, ranking it second among 58 counties.
The statute defines an underinsured motor vehicle as one insured for less than the uninsured motorist limits carried on the injured person's own vehicle. So if the at-fault policy carries the same limit you do, there is nothing above it to reach, no matter how large the loss. Coverage also does not apply until the liability limits on every vehicle that caused the injury have been exhausted by payment of judgments or settlements and proof of that payment has been submitted to your carrier. What arrives is the difference between the two numbers, reduced further by what has already been paid.
Signing first. The same statute excludes coverage where the insured, without the insurer's written consent, settles with a person who may be legally liable or takes that person to judgment. A quick check from the other driver's carrier, endorsed and deposited, can therefore erase the coverage on your own policy that was going to carry the rest of the claim. The order is fixed: identify every policy, read the endorsement, ask for consent in writing, then decide about the liability payment.
It behaves like an opposing party, because on this claim it is one. Expect requests for wage-loss information and medical record releases, due within ten days of the request, and a medical examination arranged no sooner than ten and no later than twenty days out. Disputes go to a single neutral arbitrator rather than a jury. And no cause of action accrues under the coverage unless, within two years of the crash, suit is filed against the uninsured motorist, an agreement on the amount is concluded, or arbitration is formally instituted by written notice sent certified mail with return receipt requested. A carrier must warn an unrepresented claimant of the applicable limitation at least thirty days out, but that notice duty falls away once it knows an attorney is involved.
The file opens with the policy rather than the story: declarations page, uninsured and underinsured limits, any signed deletion or reduction agreement, the endorsement's notice and consent terms, and the crash report showing which agency took the twenty-four-hour report. Fees on this kind of claim are governed by California's own rules, not a fixed number. Rule of Professional Conduct 1.5(a) prohibits an unconscionable or illegal fee, and Business and Professions Code 6147 requires the written agreement to state the rate, explain how costs affect both the fee and what the client keeps, and say in plain terms that the rate is negotiable. Arbitration under the policy also has costs of its own, which belong on a separate line from any percentage.
